Terms of Service

These terms apply to viaroo, the website builder available at viaroo.me (the "Service"), operated by VIAROO.ME ("we", "us"). By creating an account or using the Service you agree to these terms. If you don't agree, please don't use the Service.

1. What the Service does

You describe your business, and the Service generates a WordPress website for it — texts, design, pages, blog posts and a contact form — and hosts it on a subdomain such as yourname.viaroo.me. We keep WordPress, its plugins and the theme up to date, and give you access to edit the site in WordPress.

2. Your account

• You must be at least 16 years old and able to enter a binding agreement.
• Give accurate sign-up details and keep your password secret. You are responsible for what happens in your account.
• Tell us at [email protected] if you suspect someone else has access to it.

3. AI-generated content

Texts, layouts and image choices are produced automatically with the help of artificial intelligence and stock photo services. They can contain mistakes. Review your site before you rely on it and correct anything that isn't accurate — especially facts about your business, services, opening hours and contact details. The generator is instructed not to invent reviews, statistics, prices or contact details; any contact details on your site are the ones you entered.

4. Your content

• You keep all rights to the information and materials you provide and to the content of your site.
• You give us a licence to store, process, display and back up that content only as needed to run the Service (for example, to send your description to our text generator and to host your site).
• You are responsible for everything published on your site and for having the rights to it.
• Stock photos come from Pexels under its licence, with attribution on the site. WordPress and the plugins we install are open-source software under their own licences (GPL).

5. Acceptable use

You may not use the Service or your site to:

• break the law, or publish content that is illegal where you or your visitors are;
• send spam, run phishing or scams, impersonate other people or businesses, or collect data deceptively;
• distribute malware or attack, overload or probe our systems or anyone else's;
• publish sexually explicit content, content that exploits minors, or content promoting violence, hatred or discrimination;
• infringe copyrights, trademarks or other rights;
• create sites in bulk or automate sign-ups, or resell the Service without our written permission.

We may review, disable or remove sites and accounts that break these rules, and we may refuse to generate content for a request that appears to break them. Where reasonable we will tell you first; for serious or illegal abuse we may act immediately. Report abuse to [email protected].

6. Plans, subdomains and the viaroo credit

• The Service is currently free, with a limit on the number of sites per account (today: 3). Paid plans may be introduced later; we will never charge you without your explicit agreement.
• Sites on the free plan show a small "Website made with viaroo" link in the footer. Please don't remove it.
• Subdomains of viaroo.me remain ours; we assign them to your sites while your account is active. We may refuse or change a subdomain that is misleading, offensive or reserved.
• We may change limits and features of the free plan. If a change takes something away from you, we will announce it in advance.

7. Sites made by viaroo

Besides customer sites, we publish example sites generated by the Service for fictional businesses, to show what it can do. They use placeholder contact details reserved for fiction and are not offers of real businesses.

8. Availability and changes

We work to keep the Service and your site online and secure, back them up regularly and update the software. We don't guarantee uninterrupted availability, and we may change, suspend or discontinue features. If we ever shut the Service down, we will give you at least 30 days' notice and a way to export your site's content.

9. Deleting your site or account

• You can delete any of your sites at any time from your account. The site, its database and the contact-form messages it received are deleted; backup copies expire within about 30 days.
• To delete your account, email [email protected] from the address you signed up with.
• We may suspend or close accounts that break these terms (see section 5).

10. Disclaimers and liability

The Service is provided "as is" and "as available". To the extent permitted by law, we disclaim warranties that it will meet your needs, be error-free, or that generated content will be accurate or suitable for a particular purpose.

To the extent permitted by law, we are not liable for indirect or consequential losses (such as lost profits, revenue, data or goodwill), and our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim or 50 euros. Nothing in these terms limits liability that cannot be limited by law, such as liability for fraud or for death or personal injury caused by negligence.

How we handle personal data is described in our Privacy Policy.

12. Changes to these terms

We may update these terms. We will post the new version here with a new date and, for material changes, notify you by email or in your account before they take effect. If you keep using the Service after that, the new terms apply.

13. Governing law

These terms are governed by the law applicable at the operator's place of establishment. If you are a consumer, you keep the protection of the mandatory laws of the country where you live, and you may bring claims in its courts.
